2Who can order

You must be at least 18 years old to place an order. By placing an order, you confirm that you are 18 or older, that the information you give us is accurate, and that you are authorized to use the payment card you provide.

Our gear is sold for your own games, not for reselling. An order that looks like it is headed for a resale shelf can be turned down.

3Products, photos and descriptions

We sell games and sports equipment, including pickleball, backyard games, racquet and table sports and disc golf gear, along with consumable items such as overgrip tape, chalk, nasal strips, shuttlecocks and table tennis balls.

Every product page lists what is in the box, how big it is, what it is made of and what colour it comes in, and we work to keep those details correct. The product images on this site are digital renders made with an image generator to show the design, colours and contents of each product. The item you receive may differ slightly in shade, finish or packaging, and colours can look different from one screen to another. Measurements and weights are approximate.

Products, their details and the lineup itself can change, and an item can be dropped from the store, without advance notice.

4Prices and orders

All prices are in U.S. dollars. The price of each item is the price shown at checkout when you place your order. Standard shipping to the addresses we serve is free.

A single order can hold up to 20 units of any one product. Placing an order is you offering to buy what is in it; the deal is done at the moment the order ships. Until then we can turn an order down or call it off, for example when:

• an item was listed with a clear error in its price, description or photo;
• the shipping address is outside the area we serve;
• we cannot verify the payment or suspect the order is fraudulent; or
• the quantities ordered suggest the goods are intended for resale.

Should we call off an order you have already paid for, every cent goes back to the card you used.

5Payment

We accept Visa and Mastercard. Every order is a one-time purchase, charged once for the items in that order. We do not offer subscriptions, memberships, automatic reorders or recurring charges, and we do not keep your card on file for future purchases.

Payments are handled by Woosa Payments (Woosa B.V., KvK 71751513, Zwolle, the Netherlands) in partnership with Adyen N.V., licensed and supervised by De Nederlandsche Bank. Your card details are sent to the payment processor to authorize the payment. We do not receive or store your full card number or security code.

By submitting an order you authorize us, through our payment processor, to charge your card for the order total shown at checkout. If your card issuer declines the payment, we will not process the order.

6Shipping and risk of loss

We ship to the 48 contiguous states and the District of Columbia only, as described in our Shipping Policy. Any delivery time we give is an estimate. The items become yours, and so does responsibility for loss or damage, at the moment the carrier drops them at the address you entered at checkout.

7Returns, refunds and cancellations

You may return unused items in their original packaging within 30 days of delivery, as set out in our Returns Policy, which also explains refunds, damaged items and order cancellations. Nothing in these Terms takes away any right to a refund or remedy you have under the law.

8Using our products safely

Games and sports involve physical activity and moving objects, and they carry some risk of injury and of damage to property. By using our products you accept the ordinary risks of the activity. To play sensibly:

• Read and follow any instructions and warnings that come with the product, and check it for wear or damage before each use. Stop using an item that is cracked, bent or loose.
• Set up nets, posts, baskets, boards and ladders on flat, stable ground, with enough clear space around them. Fold or take them down when you are finished and in high wind.
• Balls, bocce balls, bolas, bean bags, discs, paddles and rackets can hurt people and break things. Never throw or swing them toward anyone, and make sure the playing area is clear of people, pets, windows and vehicles before you play.
• Clamp-on table tennis nets are made for tables of a normal thickness. Do not overtighten the clamps, and remove the net before moving or folding the table.
• Children should play only with adult supervision. Keep small items, such as table tennis balls, shuttlecocks and chalk, away from young children.
• Nasal strips and overgrip tape are single-use adhesive products. Apply them only to clean, dry, unbroken skin or surfaces as described on the pack, and stop using them if you notice irritation.
• Keep chalk away from eyes and avoid breathing in loose chalk dust.
• Use each product only for its intended purpose, and do not modify it.

Our products are recreational equipment. They are not medical devices or protective equipment, and we make no claim that they will improve your health, your fitness or your game.

9Warranty disclaimer

Our Returns Policy explains what we do when an item arrives damaged, faulty or incorrect. Apart from that, and to the fullest extent permitted by law, the products and this website are provided “as is” and “as available”, and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Some states do not allow the exclusion of certain implied warranties, so some of these exclusions may not apply to you.

10Limitation of liability

As far as the law allows, neither Rocket Panda LLC nor the people who own it, run it, work for it or supply it are responsible for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost goodwill, that come from or relate to this website or our products.

As far as the law allows, the most we will owe on any claim about an order is what you paid for that order. Some liability cannot be capped by law, such as for death or personal injury that our negligence causes, and these Terms do not try to cap it.

11Your responsibility to us

You agree to indemnify and hold harmless Rocket Panda LLC from claims, losses and costs, including reasonable attorneys' fees, that arise from your misuse of our products, your breach of these Terms, or your violation of any law or the rights of another person.

12Using this website

You agree not to:

• break the law through the site, or place an order that is not genuinely yours to place;
• interfere with the site's security or operation, or try to reach parts of it that are not meant to be public;
• run bots, scrapers or other automated tools to collect content, prices or anything else from the site; or
• send us spam, malicious code or messages meant to mislead.

We may suspend access to the site or refuse orders from anyone who breaks these rules.

13Our content

The Rocket Panda Sports name, the panda logo, the product images, and the text and design of this website belong to Rocket Panda LLC and are protected by intellectual property laws. Reading pages and printing them for yourself is fine. For anything beyond that, including commercial use, ask us in writing first.

14Governing law and disputes

These Terms and any dispute arising out of them or out of your use of the site or our products are governed by the laws of the State of Washington, United States, without regard to its conflict of law rules.

Got a problem? Email us before anything else, since most things get fixed fast that way. If that does not settle it, a lawsuit belongs in a state or federal court sitting in Spokane County, Washington, and both sides agree those courts have jurisdiction. As an alternative, a claim that fits the limits of small claims court may be filed there by you or by us. Your home state's consumer protection laws still protect you, whatever this section says.

15General terms

Should a court strike out one part of these Terms, every other part still stands. Waiting to enforce a right does not mean we have given it up. These Terms, together with the policies they refer to, are the whole agreement between you and us about your use of the site and your orders.

When these Terms change, the new version goes up on this page. Each order is governed by the version that was live when you placed it.
